WEIGHT / OVERAGE: 2 tons are included. Weight over 2 tons is charged at $100 per ton up to 7 tons. Loads over 7 tons are subject to an additional $300 overweight surcharge, plus applicable disposal/overage charges.
1. Rental and Payment
The customer ("Renter") agrees to rent the dumpster, trailer, or other item identified above from Bail Out Rentals ("Owner") for the rental period shown in this Agreement. Renter agrees to pay the rental rate and all applicable delivery, pickup, weight overage, disposal, cleaning, sorting, damage, recovery, late-return, tax, and other charges disclosed in this Agreement or reasonably incurred because of the rental. Unless otherwise agreed in writing, rental charges continue until the rented item is returned to or retrieved and accepted by Owner. Any extension must be approved by Owner.
2. Dumpster Weight Limits and Overage Charges
Unless the rental order states otherwise, the dumpster rental includes up to 2 tons of disposal weight. Weight is based on the disposal facility scale ticket or other documented disposal weight. Weight over 2 tons is charged at $100 per ton, up to a total load weight of 7 tons. A load exceeding 7 tons is subject to an additional $300 overweight surcharge, in addition to the per-ton overage and any third-party disposal, handling, recovery, or regulatory charges. Owner may refuse to transport an unsafe or overloaded container until the load is reduced to a safe transport weight.
3. Prohibited and Restricted Materials
Renter may not place prohibited or hazardous materials in a dumpster unless Owner has specifically approved the material in writing. Prohibited materials include, at a minimum:
- Hazardous chemicals, fuels, oils, solvents, paints, pesticides, asbestos, batteries, medical waste, or other hazardous/regulated materials.
- Tires, unless specifically approved in advance and priced separately.
- Any material prohibited by the disposal facility, landfill, transfer station, law, regulation, or Owner policy.
If prohibited or hazardous material is discovered, Renter is responsible for all resulting disposal, handling, sorting, environmental, return/rejection, cleanup, transportation, and third-party charges, to the extent permitted by law.
4. Heavy, Dense, Steel, and Mixed Loads
Renter must disclose heavy, dense, recyclable, or special materials before delivery. Steel, concrete, dirt, gravel, brick, shingles, and similar dense materials may require a separate container, reduced fill level, separate pricing, or prior approval. Owner may require materials to be kept separate. If a load must be sorted, separated, reloaded, or rejected because materials were mixed or not disclosed, Renter is responsible for reasonable sorting, labor, disposal, and handling fees.
5. Customer Responsibility for Dumpster Contents
Renter is responsible for everything placed in the dumpster during the rental period, whether placed there by Renter, employees, contractors, household members, neighbors, or other persons. Renter represents that the description of the intended contents is accurate and agrees to notify Owner before placing materially different, restricted, or unusually heavy contents in the dumpster. Renter should keep special or restricted materials separate when instructed by Owner.
6. Delivery, Placement, Access, and Retrieval
Renter is responsible for providing a reasonably safe, stable, and accessible placement and pickup location. Renter must disclose conditions that may affect safe delivery or retrieval, including soft ground, steep grades, narrow access, low clearances, overhead lines, locked gates, parked vehicles, snow, mud, or other obstructions. Renter authorizes Owner to place the dumpster in the location directed by Renter and accepts responsibility for surface or property damage that is reasonably associated with the requested placement, except to the extent caused by Owner's negligence or misconduct.
If Owner cannot access the dumpster for pickup, exchange, or service at the scheduled time because access is blocked, unsafe, or otherwise unavailable, rental charges may continue until access is restored. Renter is also responsible for reasonable failed-trip, towing, extraction, recovery, or special-equipment charges required to retrieve the dumpster or trailer because of site conditions or Renter-caused access problems.
7. Moving or Relocating a Dumpster
Renter may not move, drag, tow, lift, relocate, or allow another person to relocate a dumpster after placement without Owner's prior approval. Renter is responsible for damage, recovery, towing, or extraction costs caused by unauthorized movement or relocation.
8. Trailer and Towing Requirements
If the rental includes a trailer, Renter is responsible for confirming that the tow vehicle, hitch, electrical connection, braking system, and towing capacity are appropriate. Before travel, Renter must inspect and properly secure the hitch/coupler, safety chains, breakaway device, lights, brakes, tires, doors/gates, ramps, and cargo. Renter is responsible for safe loading, securing cargo, observing rated capacities, and complying with applicable towing laws.
9. Condition, Care, and Damage
Renter agrees to protect the rented item from abuse, vandalism, overloading, fire, contamination, theft, and avoidable damage. Renter must promptly report damage, unsafe conditions, loss, or theft. Renter may be responsible for documented repair, replacement, recovery, towing, cleaning, disposal, and loss-of-use costs resulting from damage or loss beyond ordinary wear, to the extent permitted by law.
10. Late Return, Holdover, and Extensions
The rented item must be ready for pickup or returned by the agreed date and time. Extensions require Owner approval. Additional daily or rental-period charges may apply when the item is kept beyond the agreed term, when pickup cannot be completed because the item is inaccessible, or when Renter requests additional time.
11. Ownership
All dumpsters, trailers, and rented equipment remain the property of Bail Out Rentals. Renter receives only temporary possession and use rights. Renter may not sell, pledge, sublease, conceal, encumber, permanently relocate, or otherwise dispose of any rented item.
12. Payment Authorization and Additional Charges
Renter authorizes Owner to charge the agreed rental amount and other authorized amounts to the payment method provided. Additional post-rental charges may include documented weight overage, overweight surcharge, additional rental days, failed pickup/service attempts, sorting, prohibited-material handling, disposal, fuel, cleaning, towing, extraction/recovery, damage, missing items, and other charges allowed by this Agreement and applicable law. Owner will maintain reasonable supporting records for post-rental charges.
13. Responsibility for Claims
To the extent permitted by applicable law, Renter is responsible for claims, losses, injuries, or property damage arising from Renter's possession, placement, loading, use, transportation, or contents of the rented item, or from persons Renter permits to use or access it. Renter agrees to indemnify and hold Owner harmless from third-party claims arising from Renter's misuse, negligence, prohibited contents, unauthorized movement, or violation of this Agreement, except to the extent caused by Owner's negligence or misconduct.
14. Taxes and Government Charges
Renter is responsible for applicable sales, use, rental, disposal, environmental, toll, permit, and other governmental charges when legally required. Taxes will be calculated under current law and are not fixed by this Agreement.
15. Default and Recovery
Renter is in default if Renter fails to pay amounts when due, fails to make the rented item available for timely pickup/return, materially violates this Agreement, provides materially false information, places prohibited materials in a container, improperly transfers or conceals the rented item, or causes serious misuse or unauthorized relocation. Upon default, Owner may terminate the rental, demand immediate return or access, recover the rented item as permitted by law, and pursue amounts lawfully due.
16. Iowa Law
This Agreement is governed by the laws of the State of Iowa.
17. Entire Agreement
This Agreement, the rental order, fee schedule, photographs, scale tickets, delivery/pickup records, and any signed addenda constitute the complete agreement relating to this rental. Changes must be agreed to by Owner and Renter. Electronic signatures and electronically stored copies may be accepted to the extent permitted by law.
